इस वक्त देश पहलगाम हमले के बाद शोक में है। लेकिन सरकार की कई जिम्म्दारियां हैं। कोर्ट में जिस तरीके से वक्फ संशोधन अधिनियम के मामले में केंद्र सरकार से एक हफ्ते के अंदर मांगा गया था। वो जवाब भी सरकार को इसी मुश्किल घड़ी के बीच देना था। अब आखिरकार केंद्र सरकार ने सुप्रीम कोर्ट में जवाब दाखिल कर दिया है। सुप्रीम कोर्ट ने सरकार से कहा था कि वक्फ संशोधन कानून को लेकर जो भी सवाल उठाए थे। उसका एक एक कर प्वाइंट बाई बाई जवाब दिया। सुप्रीम कोर्ट का सवाल था कि इतनी पुरानी इमारतें वक्फ के अधीन हैं। सभी का कागज कहां से दिखाए जाएंगे। बहुत मुगल काल के भी इमारत होंगे। इसके जवाब में केंद्र सरकार ने इस पर कहा कि पिछले 100 साल में उपयोगकर्ता द्वारा वक्फ को केवल पंजीकरण के द्वारा ही मान्यता दी जाती है। 100 साल से यही नियम चलता आ रहा है। उस पंजीकरण के कागज होंगे।
सुप्रीम कोर्ट में अपने जवाब में बताया है कि वक्फ कानून में बदलाव क्यों जरूरी था। सरकार ने बताया है कि 1923 से वक्फ बाई यूजर प्रावधान के तहत रजिस्ट्रेशन जरूरी होने के बावजूद इसका गलत इस्तेमाल कर निजी और सरकारी संपत्तियों पर वक्फ घोषित किया जाता रहा, जिसे रोकना जरूरी था। केंद्र ने कहा कि वक्फ बाई यूजर की व्यवस्था खत्म होने से मुस्लिम समुदाय के वक्फ करने का अधिकार नहीं छीना गया है बल्कि उसके दुरुपयोग पर लगाम लगाई गई है। सरकार ने ये भी कहा है कि इस कानून को चुनौती देने वाले याचिकाकर्ता अदालत को गुमराह करने की कोशिश कर रहे हैं। केंद्र ने ये भी कहा है कि ये कानून वैध है और विधायी शक्ति का इस्तेमाल करके इसे बनाया गया है। सरकार ने कहा है कि वक्फ बाय यूजर को हटाने से उन वक्फ संपत्तियों पर कोई असर नहीं पड़ेगा जो पहले से रजिस्टर्ड हैं। ये भ्रामक प्रचार है कि इससे ऐसी ऐतिहासिक वक्फ संपत्तियों पर असर पड़ेगा जिनके पास वैध कागज नहीं हैं। केंद्र ने ये भी कहा कि विधायिका द्वारा की गई विधायी व्यवस्था को बदलना अस्पीकार्य है। अब पांच मई को सुप्रीम कोर्ट इस पर सुनवाई करेगा। केंद्र के जवाब पर क्या हो सकता है सुप्रीम कोर्ट का रुख?

चीफ जस्टिस संजीव खन्ना ने पिछली सुनवाई में कहा था कि हमारे पास एक विशेष परिस्थिति है। हमने समझिए खबरों के कुछ खामियों की ओर इशारा किया है और कुछ सकारात्मक बातें भी मानी है। लेकिन हम नहीं चाहते कि अंदर की बात वर्तमान स्थिति इतनी बदल जाए कि इससे पक्षकारों के अधिकार प्रभावित हों। आप सही कह रहे हैं कि सामान्यतः अदालतें कानूनों को स्थगित नहीं करतीं, लेकिन एक और सिद्धांत है कि जब याचिका कोर्ट के सामने पेंडिंग हो. तब वर्तमान स्थिति में ऐसा बदलाव न हो जिससे किसी के अधिकार प्रभावित हों। केंद्र की अंडरटेकिंग के बाद यथास्थिति कायम है लेकिन अगली सुनवाई में सुप्रीम कोर्ट का रुख तय होगा।
