इलाहाबाद उच्च न्यायालय ने यौन अपराध के एक मामले की सुनवाई करते हुए कहा है कि एक लड़की का निजी अंग पकड़ना और उसकी पायजामी का नाड़ा तोड़ना, आईपीसी की धारा 376 (दुष्कर्म) का मामला नहीं है, बल्कि ऐसा अपराध धारा 354 (बी) (किसी महिला को निर्वस्त्र करने के इरादे से हमला) के तहत अपराध की श्रेणी में आता है।
केंद्रीय महिला एवं बाल विकास मंत्री अन्नपूर्णा देवी ने शुक्रवार को इलाहाबाद उच्च न्यायालय के उस फैसले को ‘गलत’ करार दिया, जिसमें उसने कहा था कि केवल स्तन पकड़ना और ‘पजामी’ का नाड़ा तोड़ना बलात्कार का अपराध नहीं है। आज पत्रकारों से बात करते हुए केंद्रीय मंत्री ने कहा कि वह इस फैसले का समर्थन नहीं करती हैं और अदालत को इस फैसले पर पुनर्विचार करना चाहिए। उन्होंने कहा, “मैं इस फैसले का समर्थन नहीं करती हूं और अदालत को भी इस फैसले पर पुनर्विचार करना चाहिए क्योंकि इसका नागरिक समाज पर प्रतिकूल प्रभाव पड़ेगा।”

यह आदेश दो व्यक्तियों द्वारा दायर एक पुनरीक्षण याचिका पर सुनवाई करते हुए न्यायमूर्ति राम मनोहर नारायण मिश्रा ने पारित किया। इन आरोपियों ने कासगंज के विशेष न्यायाधीश द्वारा पारित एक आदेश को चुनौती देते हुए यह पुनरीक्षण याचिका दायर की थी। इस मामले के तथ्यों के मुताबिक, विशेष न्यायाधीश (पॉक्सो अधिनियम) की अदालत में एक आवेदन दाखिल करके आरोप लगाया गया था कि 10 नवंबर, 2021 को शाम करीब पांच बजे शिकायतकर्ता महिला अपनी 14 वर्षीय बेटी के साथ ननद के घर से लौट रही थी। दाखिल आवेदन में आरोप लगाया गया था महिला के गांव के ही रहने वाले पवन, आकाश और अशोक रास्ते में उसे मिले और पूछा कि वह कहां से आ रही है।
