बताया जा रहा है कि जब जस्टिस यशवंत वर्मा होली की छुटि्टयों के दौरान बाहर गये हुए थे तभी उनके सरकारी बंगले में आग लग गयी। आग के बारे में जब जज के परिजनों को सूचित किया गया तो उन्होंने आपातकालीन सेवाओं को फोन पर इसकी जानकारी दी।
दिल्ली उच्च न्यायालय के एक न्यायाधीश के घर से बड़ी मात्रा में नकदी बरामद होने के मामले में भारत के प्रधान न्यायाधीश संजीव खन्ना ने कड़ी कार्रवाई की है। हम आपको बता दें कि जज के घर से बड़ी मात्रा में नकदी बरामद होने की खबर सुनते ही प्रधान न्यायाधीश ने तत्काल सुप्रीम कोर्ट कॉलेजियम की बैठक बुलाई और निर्णय लिया गया कि जस्टिस यशवंत वर्मा को दिल्ली उच्च न्यायालय से वापस इलाहाबाद उच्च न्यायालय भेज दिया जायेगा। हम आपको बता दें कि जस्टिस यशवंत वर्मा इलाहाबाद उच्च न्यायालय से ही दिल्ली लाये गये थे।
बताया जा रहा है कि जब जस्टिस यशवंत वर्मा होली की छुटि्टयों के दौरान बाहर गये हुए थे तभी उनके सरकारी बंगले में आग लग गयी। आग के बारे में जब जज के परिजनों को सूचित किया गया तो उन्होंने आपातकालीन सेवाओं को फोन पर इसकी जानकारी दी। सूत्रों ने बताया कि जस्टिस वर्मा के सरकारी आवास में उस समय आग लग गई जब वे शहर में नहीं थे। उनके परिवार के सदस्यों ने फायर ब्रिगेड और पुलिस को सूचना दी। आग बुझाने के बाद फायर ब्रिगेड कर्मियों ने बंगले के विभिन्न कमरों में भारी मात्रा में नकदी बरामद की। इसके बाद फायर ब्रिगेड कर्मियों ने इसकी सूचना पुलिस को दी और पुलिस के अधिकारियों ने इस बारे में न्यायिक तंत्र को सूचना दी। इसके बाद घटना की जानकारी मिलने पर भारत के मुख्य न्यायाधीश संजीव खन्ना ने कॉलेजियम की बैठक बुलाई। बैठक में सर्वसम्मति से जस्टिस वर्मा को वापस इलाहाबाद उच्च न्यायालय में स्थानांतरित करने का निर्णय लिया गया, जहां वे अक्टूबर 2021 तक कार्यरत थे। सूत्रों ने बताया कि जस्टिस वर्मा के खिलाफ जांच शुरू करने और महाभियोग की कार्यवाही शुरू करने पर भी चर्चा चल रही है। कॉलेजियम के कुछ जजों ने चिंता जताई है कि जस्टिस वर्मा को स्थानांतरित करने मात्र से न्यायपालिका की छवि खराब होगी और कानूनी व्यवस्था में जनता का विश्वास खत्म होगा। उन्होंने जस्टिस वर्मा से स्वेच्छा से इस्तीफा मांगा है। अगर वे इंकार करते हैं तो संसद में महाभियोग की प्रक्रिया शुरू की जा सकती है।
जस्टिस वर्मा ने अभी तक नकदी की बरामदगी पर कोई प्रतिक्रिया नहीं दी है। हम आपको बता दें कि 1999 में सुप्रीम कोर्ट ने संवैधानिक न्यायालय के न्यायाधीशों के खिलाफ भ्रष्टाचार, गलत काम और न्यायिक अनियमितता के आरोपों से निपटने के लिए दिशा-निर्देश निर्धारित किए थे। इन दिशा-निर्देशों के अनुसार, शिकायत मिलने पर मुख्य न्यायाधीश सबसे पहले संबंधित न्यायाधीश से जवाब मांगेंगे। अगर वह जवाब से असंतुष्ट हैं या उन्हें लगता है कि मामले में आगे जांच की जरूरत है, तो वह एक आंतरिक समिति का गठन करेंगे। इस समिति में एक सर्वोच्च न्यायालय के न्यायाधीश और दो उच्च न्यायालय के मुख्य न्यायाधीश शामिल होंगे। समिति द्वारा रिपोर्ट प्रस्तुत करने के बाद यदि मुख्य न्यायाधीश की राय में कथित कदाचार गंभीर प्रकृति का है जिसके लिए उसे हटाया जाना आवश्यक है, तो वह न्यायाधीश से इस्तीफा देने के लिए कहेंगे। यदि न्यायाधीश इस्तीफा देने से इंकार करते हैं, तो मुख्य न्यायाधीश संविधान के अनुच्छेद 124(4) के तहत संसद द्वारा उन्हें हटाने के लिए कार्यवाही शुरू करने के लिए सरकार को लिखेंगे।
