बीसीसीआई को कोच्चि टस्कर्स केस में बॉम्बे हाईकोर्ट से बड़ा झटका लगा है। हाईकोर्ट ने बीसीसीआई की याचिका खारिज कर दी है। अदालत ने कोच्चि टस्कर्स के मालिकों के पक्ष में 538 करोड़ रुपये के आर्बिट्रल अवॉर्ड को सही करार दिया। बीसीसीआई ने कोच्चि टस्कर्स टीम को साल 2011 में आईपीएल से बाहर कर दिया था। उसके बाद कोच्चि टीम ने बीसीसीआई के खिलाफ आर्बिट्रेशन केस किया था। फ्रेंचाइजी सिर्फ एक आईपीएल सीजन में खेली और अंक तालिका में आठवें स्थान पर थी।
जज आरआई चागला ने बीसीसीआई और कोच्चि क्रिकेट प्राइवेट लिमिटेड और अन्य मामले में कहा कि अदालत मध्यस्थ के निष्कर्षों पर अपीलीय प्राधिकारी के रूप में कार्य नहीं कर सकती। कोर्ट ने कहा कि मध्यस्थता अधिनियम की धारा 34 के तहत इस न्यायालय का अधिकार क्षेत्र बहुत सीमित है। विवाद के गुण-दोषों की गहराई से जांच करने का बीसीसीआई का प्रयास अधिनियम की धारा 34 में निहित आधारों के दायरे की विपरीत है। साक्ष्य और/या गुण-दोषों के संबंध में दिए गए निष्कर्षों के बारे में बीसीसीआई का असंतोष अवॉर्ड को चुनौती देने का आधार नहीं हो सकता।
कोच्चि टस्कर्स फ्रेंचाइजी को रेंडेजवस स्पोर्ट्स वर्ल्ड ने लिया था। बाद में फ्रेंचाइजी को कोच्चि क्रिकेट प्राइवेट लिमिटेड द्वारा संचालित किया गया। बीसीसीआई ने सितंबर 2011 में फ्रेंचाइजी समझौते के उल्लंघन का हवाला देकर कोच्चि टस्कर्स को समाप्त कर दिया। बीसीसीआई ने कहा कि फ्रेंचाइजी बैंक गारंटी देने में विफल रही थी। वहीं, केसीपीएल ने कहा कि देरी अनसुलझे मुद्दों के कारण हुई, जिसमें स्टेडिमय की अनुपलब्धता, शेयरहोल्डिंग पर विनियामक अनुमोदन और आईपीएल मैच की संख्या में कमी शामिल थी।
देरी के बीच बीसीसीआई और केसीपीएल कई महीनों तक संपर्क में रहे थे। बोर्ड ने कई भुगतान भी स्वीकार किए। लेकिन अचानक बीसीसीआई ने फ्रेंचाइजी को समाप्त कर दिया और आरएसडब्ल्यू द्वारा जारी की गई पूर्व गारंटी को भी भुना लिया। केसीपीएल और आरएसडब्लू ने 2012 में मध्यस्थता कार्यवाही शुरू की और ट्रिब्यूनल ने 2015 में उनके पक्ष में फैसला सुनाया। केसीपीएल को 384 करोड़ रुपये और आरएसडब्लू को 153 करोड़ रुपये देने का आदेश दिया गया था। इसके साथ ही ब्याज और लीगल कॉस्ट भी देने का जिक्र था।
