दिल्ली के मशहूर अपोलो अस्पताल मामले में उच्चतम न्यायालय ने कहा है कि यदि गरीब लोगों का इंद्रप्रस्थ अपोलो अस्पताल में मुफ्त इलाज उपलब्ध नहीं किया जाएगा तो वह अखिल भारतीय आयुर्विज्ञान संस्थान (एम्स) को इसे अपने नियंत्रण में लेने को कहेगा।
आपने अक्सर देखा होगा कि जन सेवा के लिए अस्पताल बनाने की बात कहते हुए उद्योग घराने सरकार से बहुत सस्ती दरों पर बेशकीमती जमीन ले लेते हैं और फिर उस जमीन पर बने अस्पताल में एक तरह से सिर्फ अमीरों का ही इलाज होता है क्योंकि गरीब के पास उस अस्पताल की फीस चुकाने की हिम्मत ही नहीं होती। जबकि अस्पताल के लिए जमीन लेते समय प्रबंधन ने इस शर्त पर हस्ताक्षर किये होते हैं कि उनके यहां एक निश्चित मात्रा में गरीबों का मुफ्त में इलाज होगा। लेकिन हकीकत बिल्कुल अलग होती है। आप किसी भी निजी अस्पताल के बाहर या अंदर जाकर पता कर लीजिये, शायद ही किसी गरीब को मुफ्त में इलाज मिला होगा। अक्सर देखने में तो यहां तक आता है कि गरीबों को इन फाइव स्टार अस्पतालों के आसपास भी फटकने नहीं दिया जाता। लेकिन अब निजी अस्पतालों की मनमानी और इस मनमानेपन की ओर सरकार की अनदेखी को लेकर देश के उच्चतम न्यायालय ने गंभीर टिप्पणी की है।
दिल्ली के मशहूर अपोलो अस्पताल मामले में उच्चतम न्यायालय ने कहा है कि यदि गरीब लोगों का इंद्रप्रस्थ अपोलो अस्पताल में मुफ्त इलाज उपलब्ध नहीं किया जाएगा तो वह अखिल भारतीय आयुर्विज्ञान संस्थान (एम्स) को इसे अपने नियंत्रण में लेने को कहेगा। हम आपको बता दें कि न्यायमूर्ति सूर्यकांत और न्यायमूर्ति एन कोटिश्वर सिंह की पीठ ने पट्टा समझौते के कथित उल्लंघन को गंभीरता से लिया है जिसके तहत इंद्रप्रस्थ मेडिकल कॉरपोरेशन लिमिटेड (आईएमसीएल) द्वारा संचालित अस्पताल को अपने यहां एक तिहाई गरीब मरीजों को भर्ती करना था तथा उनका एवं बाह्य रोग विभाग में 40 प्रतिशत मरीजों को बिना किसी भेदभाव मुफ्त इलाज करना था। पीठ ने कहा, ”अगर हमें पता चला कि गरीब लोगों को मुफ्त इलाज नहीं दिया जा रहा है तो हम अस्पताल को एम्स को सौंप देंगे।’’
पीठ ने कहा कि अपोलो समूह द्वारा दिल्ली के पॉश इलाके में 15 एकड़ भूमि पर निर्मित अस्पताल के लिए एक रुपये के प्रतीकात्मक पट्टे पर यह जमीन दी गयी थी और उसे ‘बिना लाभ और बिना हानि’ के फार्मूले पर चलाया जाना था, लेकिन यह एक शुद्ध वाणिज्यिक उद्यम बन गया है, जहां गरीब लोग मुश्किल से इलाज करा पाते हैं। वहीं आईएमसीएल की ओर से पेश वकील ने कहा कि अस्पताल एक संयुक्त उद्यम के रूप में चलाया जा रहा है तथा दिल्ली सरकार की इसमें 26 प्रतिशत हिस्सेदारी है एवं उसे भी कमाई से बराबर का फायदा हुआ है।
न्यायमूर्ति सूर्यकांत ने वकील से कहा, ‘‘अगर दिल्ली सरकार गरीब मरीजों की देखभाल करने की बजाय अस्पताल से मुनाफा कमा रही है, तो यह सबसे दुर्भाग्यपूर्ण बात है।’’ पीठ ने कहा कि अस्पताल को 30 साल के लिए पट्टे पर जमीन दी गई थी और इस पट्टे की अवधि 2023 में समाप्त होनी थी। उच्चतम न्यायालय ने केंद्र और दिल्ली सरकार से यह पता लगाने को कहा कि इसका पट्टा समझौता नवीनीकृत किया गया या नहीं। हम आपको बता दें कि शीर्ष अदालत आईएमसीएल की एक याचिका पर सुनवाई कर रही थी, जिसमें दिल्ली उच्च न्यायालय के 22 सितंबर, 2009 के आदेश को चुनौती दी गई थी। उच्च न्यायालय ने कहा था कि अस्पताल प्रशासन ने अंदरूनी (इनडोर-भर्ती) और बाह्य (आउटडोर) गरीब मरीजों को मुफ्त इलाज देने के समझौते की शर्त का उल्लंघन किया है। शीर्ष अदालत ने केंद्र और दिल्ली सरकार से पूछा कि अगर पट्टा समझौता नहीं बढ़ाया गया है तो उक्त जमीन के संबंध में क्या कानूनी कवायद की गई है। पीठ ने अस्पताल में मौजूदा कुल बिस्तरों की संख्या भी पूछी तथा पिछले पांच वर्षों के ओपीडी मरीजों का रिकॉर्ड मांगा।
