एक देश एक चुनाव विधेयक की जांच कर रही संयुक्त संसदीय समिति के समक्ष पेश हुए पूर्व सॉलिसिटर जनरल हरीश साल्वे ने विश्वास जताया कि विधेयक किसी संवैधानिक प्रावधान का उल्लंघन नहीं करता है और उन्होंने उन आरोपों को खारिज कर दिया कि इससे देश के संघीय ढांचे को नुकसान पहुंचेगा। मध्यावधि चुनाव या पूरा कार्यकाल समाप्त होने से पहले चुनाव होने की स्थिति में क्या होगा, इस बारे में सदस्यों द्वारा व्यक्त की जा रही आशंकाओं पर साल्वे ने समिति को बताया कि बेशक, कानून के भीतर प्रावधान है कि किसी भी संसद या विधानसभा का कार्यकाल पाँच साल तक होता है और इसे बढ़ाया नहीं जा सकता। हालाँकि, न्यूनतम कार्यकाल क्या होना चाहिए, इस पर कोई संवैधानिक स्थिति नहीं है। यह देखने के लिए विकल्प पर विचार करना चाहिए कि क्या विधायक कानून के तहत कोई प्रावधान बनाना चाहेंगे।

साल्वे पूर्व राष्ट्रपति रामनाथ कोविंद के नेतृत्व में केंद्र सरकार द्वारा गठित हाई-प्रोफाइल समिति के सदस्य भी रहे हैं। उन्होंने यह भी तर्क दिया कि इस तरह का कानून लाकर लोगों के वोट देने के अधिकार को नहीं छीना जा रहा है, जिसका अनिवार्य रूप से मतलब है कि संवैधानिक प्रावधानों का उल्लंघन नहीं किया जा रहा है। उन्होंने यह भी कहा कि मूल ढांचे की रक्षा की जा रही है। मूल ढांचे का उद्देश्य संविधान को स्थिर या जीवाश्म बनाना नहीं है बल्कि सीमाएँ बनाना है। कहा जाता है कि साल्वे ने समिति को बताया कि अनुच्छेद 172 में संशोधन करके या अनुच्छेद 82ए(2) को शामिल करके, प्रस्तावित विधेयक राज्य को संघ के अधीन नहीं बनाता है। वरिष्ठ अधिवक्ता हरीश साल्वे और दिल्ली उच्च न्यायालय के पूर्व मुख्य न्यायाधीश एपी शाह दोनों से लगभग पांच घंटे की बैठक में भाजपा सांसद पीपी चौधरी की अध्यक्षता वाली समिति के सदस्यों ने अलग-अलग सवाल पूछे। हां साल्वे को करीब तीन घंटे लगे वहीं शाह का सत्र दो घंटे में समाप्त हुआ।
