एडीआर की ओर से पेश वकील प्रशांत भूषण ने कहा कि हम मांग कर रहे हैं कि सुप्रीम कोर्ट के फैसले के अनुसार ईसीआई को जो प्रक्रिया अपनाने की जरूरत है वह उनके मानक ऑपरेटिंग प्रोटोकॉल के अनुरूप हो। हम जो चाहते हैं वह यह है कि किसी को ईवीएम के सॉफ्टवेयर और हार्डवेयर की जांच करनी चाहिए ताकि यह देखा जा सके कि सॉफ्टवेयर और हार्डवेयर में हेरफेर का कोई तत्व है या नहीं।

सुप्रीम कोर्ट ने चुनाव आयोग से उस याचिका पर 15 दिनों के भीतर अपना जवाब दाखिल करने को कहा है, जिसमें पोल ​​पैनल को ईवीएम की जली हुई मेमोरी की जांच और सत्यापन को उनकी मानक संचालन प्रक्रियाओं में शामिल करने का निर्देश देने की मांग की गई है। कृपया डेटा मिटाएं नहीं और डेटा पुनः लोड करें। सुप्रीम कोर्ट ने चुनाव आयोग से कहा कि किसी को जांच करने दीजिए। आवेदन एसोसिएशन फॉर डेमोक्रेटिक रिफॉर्म्स (एडीआर) द्वारा दायर किया गया था। मुख्य न्यायाधीश संजीव खन्ना और न्यायमूर्ति दीपांकर दत्ता की पीठ ने बुधवार को मामले की सुनवाई की। 

सुनवाई के दौरान, एडीआर की ओर से पेश वकील प्रशांत भूषण ने कहा कि हम मांग कर रहे हैं कि सुप्रीम कोर्ट के फैसले के अनुसार ईसीआई को जो प्रक्रिया अपनाने की जरूरत है वह उनके मानक ऑपरेटिंग प्रोटोकॉल के अनुरूप हो। हम जो चाहते हैं वह यह है कि किसी को ईवीएम के सॉफ्टवेयर और हार्डवेयर की जांच करनी चाहिए ताकि यह देखा जा सके कि सॉफ्टवेयर और हार्डवेयर में हेरफेर का कोई तत्व है या नहीं। 

मुख्य न्यायाधीश खन्ना ने पूछा कि एक बार वोट गिने जाने के बाद क्या पेपर ट्रेल वहीं रहेगा या निकाल लिया जाएगा? भूषण ने जवाब दिया, उन्हें ईवीएम को भी बचाना चाहिए, पेपर ट्रेल को भी बचाना चाहिए। दोनों पक्षों की दलीलें सुनने के बाद, अदालत ने अपने पहले के आदेश को स्पष्ट करते हुए कहा कि हम नहीं चाहते थे कि गिनती तक कोई गड़बड़ी हो (पहले के आदेश के माध्यम से) साथ ही, हम चाहते थे (देखें) कि क्या किसी को कोई संदेह है। हम नहीं चाहते थे कि ईवीएम के साथ छेड़छाड़ की जाए, हम चाहते थे कि शायद इंजीनियरिंग यह बता सके कि क्या कोई छेड़छाड़ हुई है। इसके बाद अदालत ने चुनाव आयोग को अगले 15 दिनों में याचिका पर अपना जवाब दाखिल करने का निर्देश दिया।
