हाई कोर्ट ने कहा कि प्रतिवादी 1947-48 से इस संपत्ति पर काबिज था। यह भी सच है कि प्रतिवादी इस संपत्ति की खरीद के सबूत के तौर पर कोई भी मालिकाना हक का दस्तावेज पेश नहीं कर पाया, फिर भी यह किसी भी तरह से वादी को लाभ नहीं पहुंचाता, जिसे अपना मामला खुद ही स्थापित करना है और कब्जे का आदेश प्राप्त करने के लिए इसे साबित करना है।
