याचिकाकर्ता विजय किशोर गोस्वामी की ओर से पेश वकील ने दलील दी कि मंदिरों में दर्शन के लिए वीआईपी को विशेष सुविधा देना मनमाना है और संविधान के अनुच्छेद 14 के तहत समानता के सिद्धांतों का उल्लंघन है। उन्होंने कहा कि मानक संचालन प्रक्रिया (एसओपी) बनाई जानी चाहिए ताकि सभी को समान अवसर मिले।
सुप्रीम कोर्ट ने मौखिक रूप से कहा कि मंदिरों में प्रवेश के मामले में किसी के साथ कोई विशेष व्यवहार नहीं किया जाना चाहिए, लेकिन मंदिरों में वीआईपी दर्शन सुविधाओं को समाप्त करने की मांग वाली याचिका पर कार्रवाई करने से इनकार कर दिया। हालांकि, न्यायमूर्ति संजीव खन्ना और न्यायमूर्ति एस सी शर्मा की पीठ ने कहा कि संबंधित अधिकारी उचित समझे जाने वाली कोई भी कार्रवाई करने के लिए स्वतंत्र हैं। अदालत ने कहा कि हालाँकि हमारी राय हो सकती है कि मंदिरों में प्रवेश के संबंध में कोई विशेष उपचार नहीं दिया जाना चाहिए, लेकिन हमें नहीं लगता कि यह अनुच्छेद 32 के तहत अधिकार क्षेत्र का प्रयोग करने के लिए एक उपयुक्त मामला है। हम स्पष्ट करते हैं कि याचिका को खारिज करने से किसी भी तरह से रोक नहीं लगेगी। उचित अधिकारियों को उनकी आवश्यकता के अनुसार कार्रवाई करने से रोकें।

वकील ने बताया कि देश के कुल पर्यटन क्षेत्र में धार्मिक पर्यटन 50 प्रतिशत से अधिक है, और कहा कि अब 12 ज्योतिर्लिंगों और सभी शक्तिपीठों में विशेष दर्शन सुविधाओं का पालन किया जाता है। याचिका में तर्क दिया गया कि मंदिरों द्वारा निकट से दर्शन के लिए भक्तों से शुल्क लेना उन भक्तों के प्रति भेदभावपूर्ण है जिनके पास वीआईपी प्रवेश शुल्क का भुगतान करने के लिए वित्तीय संसाधन नहीं हैं।
