न्यायाधीश ने आगे कहा कि यह मुद्दा केवल एक आवंटन का नहीं, बल्कि इस व्यापक प्रश्न का है कि ऐसे मामलों में विवेकाधिकार का प्रयोग कैसे किया जाता है। दिल्ली उच्च न्यायालय ने केंद्र से आवासीय आवंटन की मौजूदा नीति, पिछले आवंटनों का विवरण और नियमों के लागू होने के तरीके को रिकॉर्ड में शामिल करते हुए एक हलफनामा दाखिल करने को कहा।

दिल्ली हाई कोर्ट ने कहा कि सरकारी आवासों का आवंटन निष्पक्ष और पारदर्शी प्रणाली के अनुसार होना चाहिए और यह अधिकारियों की मनमानी पर निर्भर नहीं होना चाहिए। अदालत ने यह टिप्पणी आम आदमी पार्टी की उस याचिका पर सुनवाई के दौरान की जिसमें पार्टी के राष्ट्रीय संयोजक और पूर्व मुख्यमंत्री अरविंद केजरीवाल के लिए राजधानी में आवासीय आवास की मांग की गई थी। न्यायमूर्ति सचिन दत्ता ने मामले की सुनवाई करते हुए कहा कि एक पारदर्शी व्यवस्था होनी चाहिए और यह पूरी तरह आपकी मनमानी पर निर्भर नहीं हो सकती। जब तक एक स्पष्ट और स्पष्ट नीति मौजूद है।  जानना चाहता हूँ कि प्राथमिकता का आकलन किस तरह किया जाता है।

न्यायाधीश ने आगे कहा कि यह मुद्दा केवल एक आवंटन का नहीं, बल्कि इस व्यापक प्रश्न का है कि ऐसे मामलों में विवेकाधिकार का प्रयोग कैसे किया जाता है। दिल्ली उच्च न्यायालय ने केंद्र से आवासीय आवंटन की मौजूदा नीति, पिछले आवंटनों का विवरण और नियमों के लागू होने के तरीके को रिकॉर्ड में शामिल करते हुए एक हलफनामा दाखिल करने को कहा। 16 सितंबर क, न्यायालय ने निर्णय लेने में सरकार की देरी की आलोचना करते हुए कहा था कि उसका दृष्टिकोण सभी के लिए मुफ्त व्यवस्था जैसा है और आवंटन का निर्णय चुनिंदा रूप से नहीं किया जा सकता। इसके बाद केंद्र से 18 सितंबर तक वर्तमान प्रतीक्षा सूची और नीतिगत ढाँचा प्रस्तुत करने को कहा गया था।

आज की कार्यवाही के दौरान, केंद्र के वकील ने अदालत को बताया कि केजरीवाल के लिए आप द्वारा प्रस्तावित 35, लोधी एस्टेट स्थित बंगला इसी साल 24 जुलाई को केंद्रीय वित्त राज्य मंत्री पंकज चौधरी को आवंटित किया जा चुका है। यह दलील आवंटन की सही तारीख के बारे में अदालत द्वारा पहले पूछे गए प्रश्न के जवाब में दी गई। बसपा प्रमुख मायावती ने मई में यह संपत्ति खाली कर दी थी। आप की ओर से वरिष्ठ अधिवक्ता राहुल मेहरा ने दलील दी कि पार्टी के प्रस्ताव पर विचाराधीन होने के बावजूद, बंगला कहीं और आवंटित कर दिया गया। उन्होंने कहा कि सभी पूर्व शर्तें पूरी हो चुकी हैं। एक राष्ट्रीय संयोजक हैं, जो राष्ट्रीय अध्यक्ष भी हैं। हम केंद्र में स्थित आवास का अनुरोध कर रहे हैं।
